1. Acceptance of Terms
By accessing or using PrintShark (“the Service,” “we,” “our”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. PrintShark operates as an independent third-party application that integrates with the Etsy Open API v3.
2. Description of the Service
PrintShark is a listing management, market research, and optimization tool for Etsy sellers. It uses the Etsy Open API v3, with the seller’s explicit OAuth authorization, to help users:
- Research trends and evaluate market demand
- Generate product designs using AI image services
- Create, update, and organize Etsy listings
- Integrate with Printify for print-on-demand fulfillment
- Schedule and optimize listing performance
3. Eligibility & Account Requirements
You must be at least 18 years old and have an active Etsy seller account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You may only authorize PrintShark to access Etsy shops that you own or are authorized to manage.
4. Etsy API Compliance
The Service is bound by, and operates in compliance with, the Etsy API Terms of Use. By using PrintShark, you also agree to comply with those terms as they apply to seller-side use of API-derived data. PrintShark:
- Uses OAuth 2.0 with PKCE for all access to your shop
- Requests only the minimum scopes required for features you enable
- Respects Etsy API rate limits and never engages in screen-scraping
- Does not resell, sublicense, or share your Etsy data with third parties
5. User Responsibilities
You agree that you are solely responsible for:
- The content of any listings created or modified through the Service, including titles, descriptions, tags, images, prices, and product attributes
- Reviewing AI-generated designs and listing content before publishing to ensure they comply with Etsy’s Seller Policies, intellectual property law, and applicable consumer protection laws
- Ensuring you have the rights to use any reference imagery, prompts, or branding fed into the design pipeline
- Order fulfillment, customer service, returns, taxes, and any other obligations to your buyers
6. AI-Generated Content
Designs, mockups, titles, tags, and descriptions produced by AI services integrated with PrintShark are generated probabilistically and may occasionally produce inaccurate, low-quality, or non-compliant output. You are responsible for reviewing and approving content before it is published to your Etsy shop, and for ensuring the output does not infringe any third party’s intellectual property or violate platform policies.
7. Third-Party Services
The Service integrates with third-party providers including (but not limited to) Etsy, Printify, Google Gemini, OpenAI, Pinterest, and Facebook/Instagram. Your use of those services is also governed by their respective terms of service and privacy policies. We are not responsible for the availability, accuracy, or behavior of any third-party service.
8. Billing & Payments
Paid plans are billed through our payment processor, Stripe. By selecting a paid plan or adding a payment method, you agree to the pricing and billing terms in this section. All amounts are in U.S. dollars.
What you are charged for. The Service meters usage by product generation (one finished product design). Depending on your plan:
- Pay-as-you-go: a flat per-generation rate accrues as you use the Service and is charged to your saved payment method once your accrued balance reaches a billing threshold.
- Subscription plans (Starter, Pro, Studio): a recurring monthly fee that includes a set number of generations per billing period. Generations beyond your plan’s limit are blocked until the next period unless you upgrade or purchase a top-up pack.
- Top-up packs: one-time purchases of additional generations.
- Beta participants: may be billed at our underlying provider cost, with no markup, above any free daily allowance we grant, on the same threshold basis.
Current prices are shown in the application before you commit to a plan or purchase. We may change prices on a going-forward basis. If you hold a founder rate, it is governed by the terms under which it was offered.
Authorization to charge your stored payment method. When you add a payment method, you authorize PrintShark and Stripe to store that payment method and to charge it automatically, without requiring further action from you, for: (a) accrued pay-as-you-go or beta usage when it reaches the billing threshold; (b) recurring subscription fees on each renewal; and (c) any top-up packs you purchase. These are merchant-initiated charges against a stored credential. You may withdraw this authorization at any time by removing your payment method or canceling your plan, except for amounts already accrued or owed.
Subscription renewal and cancellation. Subscriptions renew automatically each month until canceled. You can cancel at any time from the billing area in the application, which opens the Stripe customer portal. Cancellation stops future renewals. Your plan remains active through the end of the period you have already paid for, and partial periods are not prorated.
Refunds. Because each product generation consumes paid AI compute at the moment it runs, generation charges, usage charges, and top-up purchases are non-refundable once incurred. Subscription fees are non-refundable except where required by law. If you believe you were charged in error, contact us at ds9design@gmail.com within 30 days and we will review the charge in good faith. Refunds or account credits, where granted, are at our discretion.
Failed or overdue payments. If a charge fails or a subscription becomes past due, we may retry the charge, suspend access to paid features, or downgrade your account until the balance is resolved.
Taxes. Prices are exclusive of applicable taxes. You are responsible for any sales, use, VAT, or similar taxes associated with your purchase, other than taxes based on our net income.
Payment security. Card details are handled and stored by Stripe under its own terms and security standards. PrintShark does not receive or store your full card number. We retain only limited information, such as the card brand and last four digits, to display your payment method.
9. Intellectual Property
You retain all rights to your shop data, your brand, your uploaded assets, and any designs published to your Etsy shop through the Service. We claim no ownership over your seller content. The PrintShark application code, branding, and documentation remain the property of PrintShark and its contributors.
10. Service Availability & Modifications
The Service is provided on an “as available” basis. We may modify, suspend, or discontinue features at any time, including in response to changes in the Etsy API or other upstream services. We will make reasonable efforts to notify active users of material changes.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT LISTINGS PUBLISHED THROUGH THE SERVICE WILL ACHIEVE ANY PARTICULAR LEVEL OF SALES OR VISIBILITY.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PALLETTE GALLERY AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
13. Indemnification
You agree to indemnify and hold harmless PrintShark, its contributors, and its affiliates from any claims, damages, liabilities, and expenses arising from your use of the Service, your listings, your shop content, or your violation of these Terms.
14. Termination
You may stop using the Service at any time and revoke API access via your Etsy account settings — Apps & Permissions. We may suspend or terminate access for users who violate these Terms, the Etsy API Terms of Use, or applicable law.
15. Changes to These Terms
We may update these Terms from time to time. The “Last updated” date at the top of this page reflects the most recent revision. Continued use of the Service after changes constitutes acceptance of the updated Terms.
