1. Acceptance of terms

These Terms of Service ("Terms") govern your access to and use of PrintShark ("PrintShark", "we", "us", or "our"). By creating an account, joining the waitlist, or otherwise using the service, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use PrintShark.

2. The service

PrintShark is an automation studio for print-on-demand sellers. It researches niches, generates designs and mockups, writes SEO listings, and can publish them to your connected Etsy shop and create products through Printify. You are responsible for reviewing what the service produces and for your shop's compliance with all marketplace rules.

3. Your account

You must provide accurate information when creating an account and keep it up to date. You are responsible for safeguarding your account credentials and for all activity that happens under your account. Notify us promptly of any unauthorized use.

4. Acceptable use

You agree not to misuse the service. In particular, you will not: break the law or infringe anyone's intellectual property; upload malicious code; attempt to disrupt, reverse engineer, or gain unauthorized access to the service; or use the service to generate or publish content that is illegal, infringing, or deceptive.

5. Marketplace compliance

PrintShark is built to help you stay compliant by drafting first, drip-feeding, and keeping you in control. It is not a tool for gaming or bypassing Etsy's rules, and you agree not to use it that way. You retain ownership of the designs, listings, and other content you create with PrintShark, subject to the terms of the underlying AI providers. You are responsible for ensuring your use complies with Etsy's policies and applicable law.

6. AI-generated content & ownership

Subject to these Terms and to the terms of the underlying AI providers, you own the outputs you generate with PrintShark: the artwork, mockups, titles, tags, and descriptions you create for your shop. Generated content is produced using third-party AI providers, and your use of those outputs is also subject to those providers' terms.

You are responsible for the originality and compliance of what you publish. AI tools can produce similar results for different users and may inadvertently resemble existing works. You agree to review outputs and ensure that what you publish is original to your shop, does not infringe third-party rights, and complies with all applicable marketplace policies and laws. You retain a license to your prompts and content as needed for us to operate the service.

7. Third-party services

PrintShark integrates with third-party services, including the Etsy API, the Printify API, and AI providers. Your use of those services through PrintShark is also governed by their respective terms and policies. We are not responsible for third-party services, and their availability or behavior is outside our control.

8. Billing, automatic charges & cancellation

Subscriptions. Paid plans are billed in advance and renew automatically each month at the then-current price for your plan until you cancel. Founding members lock in their founding rate for as long as their subscription remains active, as described on our Pricing page.

Stored payment method and automatic charges. When you add a card, you authorize PrintShark to store that payment method with our payment processor (Stripe) and to charge it automatically: (a) for your recurring subscription on each renewal, and (b) on usage-based plans, including beta and pay-as-you-go accounts, when your accrued usage reaches a billing threshold of US$10, at which point your saved card is charged for the outstanding balance. Your card details are handled by Stripe and are never stored on PrintShark's servers. Charges appear on your statement under our PrintShark billing descriptor.

Cancellation. You can cancel your subscription at any time from the Billing section of your account. Cancellation takes effect at the end of your current billing period, and you keep access until then. To stop usage-based charges, remove your saved card and discontinue use of paid features.

Refunds. Except where required by law, all charges are non-refundable. We do not provide refunds or credits for partial subscription periods, and one-time purchases, including credit packs and product packs, are non-refundable once purchased.

Price changes. We may change our prices on a going-forward basis and will give notice before a change applies to you. Continued use after a change takes effect means you accept the new price. Founding rates are honored as described above.

9. Disclaimers

PrintShark is provided "as is" and "as available," without warranties of any kind, whether express or implied. We do not warrant that the service will be uninterrupted, error-free, or that it will achieve any particular sales or business result. You use the service at your own risk.

10. Limitation of liability

To the maximum extent permitted by law, PrintShark will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising from or related to your use of the service. To the extent liability cannot be excluded, our total liability for any claim will not exceed the amount you paid us for the service in the twelve months preceding the claim.

11. Changes to these terms

We may update these Terms from time to time. When we do, we'll revise the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of PrintShark after changes take effect means you accept the updated Terms.
